Welcome to Daggertail! These Terms of Use ("Terms") govern your use of daggertail.com (the "Service") operated by Daggertail Education Inc. ("we," "our," or "us").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

1. Use of Service

Acceptable Use

You may use our Service for lawful educational purposes. You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to interfere with or disrupt the Service
• Attempt to access another user's session or data (as sessions are anonymous, this refers to unauthorized access to any stored session information)
• Submit false or misleading information
• Use automated systems or software to extract data from the Service (e.g., scraping), beyond what is permitted by any robots.txt file or API we may provide.
• Violate any applicable laws or regulations

Drill Content

The drills and educational content on our Service are provided for educational purposes. While we strive for accuracy, we make no warranties about the completeness, reliability, or accuracy of this information.

2. User Accounts and Sessions

Our Service uses session-based functionality to save your drill progress. We do not require user accounts or registration. By using the Service, you acknowledge that:

• Session data is stored for 30 days from your last activity
• You are responsible for any activity that occurs via your session, which is tied to your browser and device.
• Sessions are device and browser specific
• Clearing cookies in your browser will end your current session and reset your progress for that browser.

3. Intellectual Property

The Service and its original content (excluding user-generated drill responses), features, and functionality are and will remain the exclusive property of Daggertail Education Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of both Canada and foreign countries.

4. Privacy

Your use of our Service is also governed by our Privacy Policy. Please review our Privacy Policy, which details our data collection and use practices.

Educational Content Accuracy

The information provided through our drills is for general educational purposes only. While we strive for accuracy, it is provided "as is" without warranties of any kind, express or implied. It should not be used as a substitute for professional advice, formal instruction, or comprehensive study in any field.

Service Availability

We do not guarantee that the Service will be available at all times or be uninterrupted or error-free. We may experience hardware, software, or other problems or need to perform maintenance related to the Service, resulting in interruptions, delays, or errors.

6. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Daggertail Education Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii.any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content (including session data), whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

7. Indemnification

You agree to defend, indemnify, and hold harmless Daggertail Education Inc. and its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, any use of the Service's content, services, and products other than as expressly authorized in these Terms.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice, such as by updating the "Last Updated" date at the top of these Terms and posting the new Terms on this page. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
